Krems. For the sixth time, a Holocaust denier was convicted on Monday in Krems under the Prohibition Act. Four more years imprisonment and to be put into an institution for mentally abnormal lawbreakers was the – not yet final – judgment against the 66-year-old, now impris0ned in the prison at Stein. He had denied the existence of gas chambers during the Nazi period in letters to the Minister of Justice and others.

Former FPÖ [anti-migrant Freeedom Party] district councillor had already been sentenced to 13 years in prison

The former Vienna FPÖ district council – he had been expelled from the party in 1994 – had been sentenced in recent years to a total of 13 years in prison. The academician had to answer Monday from October 2016 to July 2017 for sending letters and petitions to courts and prosecutors from the prison at Stein.

According to the indictment, the letters were addressed, for example, to the 183 members of Parliament

….and the judges of various courts. It included the “myth of genocide” and a “Mauthausen cheater clique”.

The defendant denies the Holocaust, said the prosecutor. The 66-year-old accused her of “lies” several times during her opening speech, which earned him a warning from the presiding judge. The Prosecutor described the native of Carinthia as a “serial offender” and “recidivist offender”. Defender Wolfgang Blaschitz demanded an acquittal.

The 66-year-old admitted to having sent the letters. He referred to his early 1990s written opinion entitled “Laws of Nature versus Gas Chambers”. According to him with the gas Zyklon B no gas chambers could have been operated as described. “It’s not possible, so it can not have happened,” said the academician, demanding an examination of his report. “In Mauthausen, the gas chamber was built after the war,” he said. Nevertheless, for decades children have been “dragged” there and shown “fake gas chambers”.

Delusional personality disorder

An expert came to the conclusion that the man suffers from a delusional personality disorder and is not sane. Due to a mental perversion of a higher degree he experiences an inner compulsion to continue to represent his theses. He assumes that he has been persecuted for 25 years and speaks of a “Mauthausen clique” that wants to enrich itself. The man would continue to send such letters, though violence can not be expected, said the expert.

According to the prosecutor, the 66-year-old had written further letters since the period covered by the indictment. She applied for admission to an institution for mentally abnormal lawbreakers, but the lawyer defending him was opposed.

The jury decided unanimously after their consultation for a guilty verdict under section 3h prohibition law. In contrast to the result of the expert opinion, seven lay judges voted in the supplementary question that the 66-year-old was sane.

In addition to imprisonment, the court also issued a briefing under section 21 (2) of the Criminal Code. The danger was that further writings [letters] by the man “would draw unstable persons within his sphere of influence who would believe in [the concept of] the ‘Auschwitz lie,” said the presiding judge.

The prosecutor made no statement. The defense attorney filed an appeal for nullity and appeal. Thus, the judgment is not final.
